GENERAL TERMS AND CONDITIONS FOR REMOVALS, STORAGE, PET TRANSPORT, CLEARING OUT AND REGIE WORK
1. services
1.1 The Freight Forwarder shall provide his services with due care and attention to the interests of the Customer against payment of the agreed
remuneration.
1.2 If unforeseeable expenses arise in the course of the contractual performance, these shall be reimbursed by the Principal, provided that the
Freight Forwarder was entitled to consider them necessary under the circumstances.
1.3 If the Customer extends the scope of services after conclusion of the contract, the additional costs incurred shall be reimbursed by the
Customer to a reasonable amount.
1.4 Unless otherwise agreed in writing, the Freight Forwarder's personnel shall not carry out any electrical, gas, dowel or other installation work
.
1.5 The Freight Forwarder's staff performing the removal on site shall have no authority to agree on amendments to the contract.
1.6 The Customer may instruct the Freight Forwarder to carry out direct labour, which shall be remunerated on a time and material basis. These GTC shall also apply accordingly
if the Customer commissions the Freight Forwarder exclusively with the performance of directing work.
2. additional load transport
The move may also be carried out as an additional load transport.
3. commissioning of third parties
The forwarder may commission a subcontractor to carry out the removal or individual services. This also applies to the performance
of storage, pet transportation, clearing out and direction work.
4. tips
Tips will not be deducted from the invoice amount.
5. reimbursement of removal costs by third parties
5.1 If the Customer has a claim for reimbursement of removal costs against a third party, he shall instruct such third party to pay the agreed and due
removal cost reimbursement less any down payments or partial payments made directly to the Freight Forwarder upon corresponding request. To this extent
the Principal assigns his corresponding claims for reimbursement against the third party to the Freight Forwarder upon signing the contract.
5.2 If the payment of the third party is not made within the contractually agreed period, the principal remains obliged to pay. In case of partial payments
the Customer shall pay the difference to the Freight Forwarder. The Freight Forwarder is entitled, but not obliged, to first demand payment from the third party
and, if necessary, to enforce this in court against the third party.
6. transport securing/duty of the client to inform
6.1 The client is obliged to secure movable or electronic parts, in particular on transport-sensitive devices, professionally for transport
. The client shall consult with the carrier in case of doubt as to which devices are to be secured accordingly. In case of doubt, the Customer shall consult with the forwarder as to which devices are to be secured accordingly.
6.2 The Freight Forwarder is not obliged to check whether the equipment has been properly secured for transport.
6.3 If the goods to be moved include dangerous goods, the Customer is obliged to inform the Freight Forwarder in due time about the nature of the danger posed by the goods
. The Freight Forwarder is entitled to check with the Customer whether the goods have been properly secured during transport. The Freight Forwarder is entitled to refuse the transport of the dangerous goods if the danger is not controllable for him.
7. special conditions for pet transports
7.1. If pet transports are ordered alone or as part of a move, in particular via the PetMove service, the Client
must ensure that the respective regulations of the country of entry and exit applicable to the transport are fulfilled, in particular the Client must present
health papers in the original. The fitness of the animal to travel must be medically examined and confirmed. If required, a
microchip must be placed in the animal and the required vaccination protection must exist.
7.2 The Client shall take out a no-fault animal owner's insurance policy with coverage of at least EUR 1 million, which shall also cover
the transport of the animal to its destination and cover the carrier. Upon request, the Customer shall provide proof of insurance to the Freight Forwarder at
. Without proof of insurance, the carrier may refuse to transport the animal.
7.3 The principal shall inform the freight forwarder about any special requirements for the transport of the animal. This applies equally to
species-related and animal-specific peculiarities. The Freight Forwarder may refuse the transport if he cannot ensure the necessary precautions or can only do so at
with special effort.
7.4 Unless otherwise agreed, animals shall not be fed during transport. If, in individual cases, feeding during transport
has been agreed, the Principal shall provide the Freight Forwarder with suitable feed and inform him how and to what extent feeding
is to be carried out. The Freight Forwarder may refuse the transport if he cannot ensure the feeding or can do so only with special effort.
7.5 The animal to be transported shall be collected by the Freight Forwarder from the Customer or a third party named by the Customer in text form and transported by means of
a suitable transport box. The transport box must meet the requirements of IATA and can be provided by the Freight Forwarder or will be provided by the
Customer. Dogs that are listed in the breed list must be transported in a special transport box. This will be made
according to the dimensions of the dog by the carrier as a special box. In the case of behavioral problems, the transport box must be provided with a warning notice
. In case of animals with behavioral problems, the Freight Forwarder is entitled to refuse the transport.
7.6 When signing the contract, the Customer shall provide the Freight Forwarder with the name of a receptionist to whom the animal will be delivered at the destination
or who will take over the animal at the respective airport and with whom communication in German or English is possible. The receiving person
can be the client or a third party. The contact details of the reception person must include a telephone number under which the
reception person can be reached at all times. If the reception person is not found at the agreed time of delivery or if the reception person cannot be reached by telephone for the
communication of changes of appointment, the forwarder can accommodate the animal at the expense and risk of the client in the local
animal shelter or another suitable place. If suitable local accommodation is not possible, the Freight Forwarder shall be entitled, but not
obliged, to return the animal to the place of dispatch at the expense and risk of the Principal and to accommodate it there at the expense and risk of the Principal in
an animal shelter or another suitable place, if the Principal or a third party commissioned by him cannot receive it there
.
7.7 If the Principal does not comply with his contractual obligations, he shall indemnify the Freight Forwarder from any liability in this respect and shall bear all
additional costs incurred as a result.
8. special conditions for clearing out
8.1. as far as clearing out is ordered, in particular via the Munich clearing out service, the client allows the
forwarder a detailed inspection of the property to be cleared out before submitting an offer.
8.2. as far as a fixed price for the clearing out has been agreed upon, this price has to be paid before the start of the work.
8.3 After the inspection, the Freight Forwarder shall indicate whether, and if so, to what extent, valuable items are present that can be set off against the agreed
price. If no agreement to this effect is made in text form, it shall be deemed agreed that no valuable
items were present.
8.4 The de-cluttering order only covers the property or the
premises expressly designated by the Client in text form. The outside area including garages, garden sheds and materials stored in the garden etc. is only included in the order if
this has been agreed in text form.
8.5 If the goods to be cleared include dangerous goods, the Customer is obliged to inform the Freight Forwarder in time about the nature of the danger
posed by the goods. The Freight Forwarder is entitled to refuse to transport the dangerous goods if the danger is not controllable for him. In case of dangerous goods not declared
in advance, the additional expenses shall be compensated by the Customer.
8.6 The Freight Forwarder is not obliged to look for any valuable objects during the unloading, unless these have been communicated by the Principal
in text form beforehand. Otherwise, the Freight Forwarder is entitled to dispose of all items located in the premises to be
cleared without further inspection.
8.7 If the premises are to be renovated after the clearing out, this is to be agreed upon separately in text form against remuneration. In this context,
the type and scope of the renovation work to be carried out, including any time specifications, shall be determined in detail. Only services expressly agreed in
text form are owed by the forwarder.
9. limitation of liability
9.1 The Freight Forwarder shall only be liable in case of intentional or grossly negligent breach of contract as well as in case of breach of warranty and breach of
cardinal obligations, i.e. obligations which enable the proper execution of the contract in the first place and on the fulfilment of which the Customer therefore relies
, as well as in case of injury of life, body or health, in each case by the Freight Forwarder or his vicarious agents. In case of breach of
warranties and cardinal obligations, claims for compensation shall be limited to the foreseeable, typical damage.
9.2 For the carriage of removal goods the legal regulations in Section IV of the German Commercial Code (HGB) shall apply, which in Section 451 e HGB provide for a limitation of the liability
of the Freight Forwarder for loss or damage to an amount of EUR 620 per cubic meter of loading space required for the performance of the contract
. If this liability sum is insufficient, the Customer shall inform the Freight Forwarder thereof. The Freight Forwarder may then take out transport insurance for the additional amount at the expense of the Customer, in accordance with instructions and
. Insofar as services are contractually agreed which are not part
of the freight contract, the liability shall be limited to 50,000.00 Euro per case of damage.
9.3 In case of services of additionally arranged craftsmen, the Freight Forwarder shall only be liable for careful selection.
9.4 The personal liability of the Freight Forwarder's employees, management and vicarious agents is limited in the same way as that of the
Freight Forwarder.
10. instructions, notifications and coordination in case of several parties involved
10.1 Instructions and notifications of the Customer regarding the performance of the agreed services shall be addressed in text form exclusively to the Freight Forwarder
.
10.2 If the Freight Forwarder acts as a subcontractor for the Customer, the Customer shall be responsible for the coordination with the Customer and any other
subcontractors. The Customer is the sole contact person of the Freight Forwarder.
11 Inspection by the Customer
When collecting the removal goods, the Customer is obliged to check that no item has been taken away in error
or left standing before completing the loading. In the case of directing work, the Customer is obliged to check the work immediately after it has been carried out and to notify
the Freight Forwarder of any complaints without delay.
12. due date of the agreed payment, assignment as security
12.1 Unless otherwise agreed by contract, the invoice amount is due before completion of delivery in the case of domestic transports, and before the start of loading in the case of
foreign transports, and is to be paid in cash or by prior transfer to the Freight Forwarder's business account.
Directed work is to be paid after completion. Unless otherwise agreed in writing, expenses shall be reimbursed separately in each case.
12.2 Expenses in foreign currency shall be settled according to the exchange rate determined on the day of payment.
12.3 If the Customer does not meet his payment obligation, the Freight Forwarder is entitled to stop the removal goods or to store them after the start of the
transport at the Customer's expense until the freight and the expenses incurred up to that point have been paid. If
the Principal still does not meet his payment obligation, the Freight Forwarder is entitled to carry out a lien sale according to the legal regulations
.
12.4 Section 419 of the German Commercial Code (HGB) shall apply accordingly.
12.5 If the Freight Forwarder acts as a subcontractor for the Customer, the Customer hereby assigns to the Freight Forwarder his claim against the Customer arising from the
project for which the Freight Forwarder is used as a subcontractor. The assignment is made to secure all claims of the
Freight Forwarder against the Customer arising from the current business relationship. The principal is entitled to collect the claim against the customer in the normal course of
business. The forwarder will only disclose the assignment to the customer if the customer is in default of payment to the
forwarder. In this case the forwarder is also entitled to revoke the direct debit authorization of the customer.
13. Lagerung
Für Lagerungen gelten ergänzend folgende Bestimmungen:
13.1. Bei Lagerungen ist der Einlagerer dazu verpflichtet, den Spediteur darauf hinzuweisen, wenn feuer- oder explosionsgefährliche oder strahlende, zur
Selbstentzündung neigende, giftige, ätzende oder übelriechende oder überhaupt solche Güter, welche Nachteile für das Lager und/oder für andere
Lagergüter und/ oder für Personen befürchten lassen, Gegenstand des Vertrages werden sollen.
13.2. Der Lagerhalter erbringt folgende Leistungen:
13.2.1. Die Lagerung erfolgt in geeigneten betriebseigenen oder -fremden Lagerräumen; den Lagerräumen stehen zur Einlagerung geeignete Möbelwagen
bzw. Container gleich. Lagert der Spediteur bei einem fremden Lagerhalter ein, so hat er dessen Namen und den Lagerort dem Auftraggeber unverzüglich
schriftlich bekanntzugeben oder, sofern ein Lagerschein ausgestellt ist, auf diesem zu vermerken.
13.2.2. Bei Einlagerung wird vom Einlagerer ein Lagerverzeichnis der eingelagerten Güter erstellt, das vom Lagerhalter nach Gegenzeichnung als verbindlich
anerkannt wird.
13.2.3. Dem Einlagerer wird nach der Übernahme eine Ausfertigung des Lagervertrages ausgehändigt oder zugesandt. Bei Teilauslagerungen erfolgen auf
dem Lagerschein oder dem Lagerverzeichnis entsprechende Abschreibungen.
13.3. Der Lagerhalter ist berechtigt, das Lagergut gegen Vorlage des Lagervertrages auszuhändigen, es sei denn, dem Lagerhalter ist bekannt oder infolge
grober Fahrlässigkeit unbekannt, dass der Vorlegende zur Entgegennahme des Lagergutes nicht befugt ist. Der Lagerhalter ist befugt, aber nicht verpflichtet,
die Legitimation desjenigen zu prüfen, der den Lagervertrag vorlegt.
13.4. Der Einlagerer ist verpflichtet, bei vollständiger Auslieferung des Lagergutes den Lagervertrag mit Verzeichnis zurückzugeben und ein schriftliches
Empfangsbekenntnis zu erteilen. Bei teilweiser Auslieferung des Lagergutes werden Lagerhalter und Einlagerer entsprechende Abschreibungen in
Schriftform auf dem Lagerverzeichnis und im Lagervertrag vornehmen.
13.5. Während der Dauer der Einlagerung ist der Einlagerer berechtigt, während der Geschäftsstunden des Lagerhalters in seiner Begleitung das Lagergut in
Augenschein zu nehmen. Der Termin ist vorher zu vereinbaren.
13.6. Der Einlagerer ist verpflichtet, etwaige Anschriftenänderungen dem Lagerhalter unverzüglich in Text oder Schriftform mitzuteilen. Er kann sich nicht
auf den fehlenden Zugang von Mitteilungen berufen, die der Lagerhalter an die letzte bekannte Anschrift gesandt hat.
13.7. Der Einlagerer ist verpflichtet, das monatliche Lagergeld im Voraus bis spätestens zum 3. Werktag eines jeden Monats an den Lagerhalter zu zahlen.
Das Lagergeld für die Folgemonate ist auch ohne besondere Rechnungserteilung zum jeweiligen Monatsbeginn fällig.
13.8. Der Lagerhalter ist nicht verpflichtet, die Echtheit der Unterschriften auf den das Lagergut betreffenden Schriftstücken oder die Befugnis des
Unterzeichners zu prüfen, es sei denn, dem Lagerhalter ist bekannt oder infolge Fahrlässigkeit unbekannt, dass die Unterschriften unecht sind oder die
Befugnis des Unterzeichners nicht vorliegt.
13.9. Ist eine feste Laufzeit des Vertrages nicht vereinbart, so können die Parteien den Vertrag unter Einhaltung einer Kündigungsfrist von einem Monat
schriftlich oder in Textform kündigen, es sei denn, es liegt ein wichtiger Grund vor, der zur Kündigung des Vertrages ohne Einhaltung der Kündigungsfrist
berechtigt.
13.10. Bei Vertragsende stellt der Lagerhalter das Lagergut zur Abholung bereit. Der Abholzeitpunkt ist mit dem Lagerhalter mindestens 5 Werktage im
Voraus abzustimmen. Holt der Einlagerer das Lagergut nicht ab, ist er weiter zur Zahlung des vereinbarten Lagergeldes verpflichtet. Darüber hinaus kann der
Lagerhalter Schadenersatz wegen des eingetretenen Verzugs geltend machen.
13.11. Der Lagerhalter hat wegen aller fälligen und nicht fälligen Forderungen aus dem Lagervertrag gegenüber dem Einlagerer ein Pfandrecht und ein
Zurückbehaltungsrecht an den in seiner Verfügungsgewalt befindlichen Gütern oder sonstigen Werten. Das Pfand- und Zurückbehaltungsrecht geht nicht
über das gesetzliche Pfand- und Zurückbehaltungsrecht hinaus.
13.12. Macht der Lagerhalter von seinem Recht zum Pfandverkauf der in seinen Besitz gelangten Gegenstände Gebrauch, so genügt für die
Pfandversteigerungsandrohung und die Mitteilung des Versteigerungstermins die Absendung einer Benachrichtigung an die nach Ziffer 5.3 mitgeteilte, letzte
dem Lagerhalter bekannte Anschrift des Einlagerers.
13.13. Der Lagerhalter darf ein Pfand- oder Zurückbehaltungsrecht wegen Forderungen aus anderen mit dem Einlagerer abgeschlossenen Verkehrsverträgen
nur ausüben, soweit sie unbestritten sind oder wenn die Vermögenslage des Schuldners die Forderung des Lagerhalters gefährdet.
13.14. An die Stelle der in § 1234 BGB bestimmten Frist von einem Monat tritt in allen Fällen eine solche von zwei Wochen.
13.15. Zeit und Ort der Versteigerung werden unter allgemeiner Bezeichnung des Pfandes öffentlich bekannt gemacht.
13.16. Bei Verträgen mit anderen als Verbrauchern gelten die ALB (Allgemeine Lagerbedingungen für Geschäftskunden) des Einlagerers als vereinbart.
14. withdrawal and termination
14.1 The removal is a service in the sense of § 312 g paragraph 2 sentence 1 number 9 BGB. There is no statutory right of withdrawal
according to § 355 BGB.
14.2 The Client may terminate the removal contract at any time. If the Principal terminates the contract, the Freight Forwarder may, if the termination is based on reasons
not attributable to his sphere of risk, at his option either
14.2.1. demand the agreed freight, the demurrage, if any, as well as expenses to be reimbursed. This amount shall be reduced by any expenses saved or otherwise acquired as a result of the
termination of the contract or which he maliciously refrains from acquiring;
14.2.2. or by a flat rate of one third of the agreed freight.
15 Place of Jurisdiction
15.1 Munich shall be the exclusive place of jurisdiction for legal disputes with merchants, legal entities under public law or special funds under public law based on this
contract and for claims based on other legal grounds related to the removal contract.
15.2 Otherwise, the exclusive jurisdiction of the Munich courts shall only apply in the event that the Client does not have a general
place of jurisdiction in Germany at the time of conclusion of the contract or relocates its domicile or usual place of residence abroad after conclusion of the contract or its domicile
or personal place of residence is not known at the time the action is filed.
16. choice of law, written form requirement and further provisions
16.1. German law shall apply.
16.2 Assignments or pledges of rights arising from the warehousing contract require the consent of the Warehouse Keeper.
16.3 Offsetting against claims of the Freight Forwarder is only permitted with due counterclaims which have been legally determined, are ready for decision or are undisputed
, provided that the Principal is a merchant, a legal entity under public law or a special fund under public law
.
16.4 Additional agreements and amendments to these terms and conditions must be made in writing. Declarations of the Freight Forwarder are only binding if they are confirmed in writing
.
16.5 As far as individual terms of the contract should be invalid, the validity of the remaining terms remains unaffected. The contracting parties
are obliged to replace the invalid provision by a provision that is as economically equivalent as possible.
17. data protection
The forwarder uses the data provided by the principal for the fulfillment and processing of the order. A passing on of the data takes place to
auxiliary persons, as far as these are used for the fulfillment of the order. A passing on of the data to other third parties does not take place. With complete
processing of the order and full payment, the data will be blocked for further use and deleted after the expiry of the tax and
commercial law regulations.
18 AMÖ conciliation body
18.1 In the event of disagreements with consumers arising from or in connection with this contract, which cannot be resolved in the relationship between the
contracting parties, the consumer may complain to the AMÖ conciliation body. This is established at
Bundesverband Möbelspedition und Logistik (AMÖ) e.V., Schulstraße 53 I 65795 Hattersheim, Tel.: 06190 989813 I Fax: 06190 989820 E-Mail:
info@amoe.de I Internet: www.amoe.de. The AMÖ conciliation body may be called upon by consumers to settle the dispute in whole or in part, provisionally or finally, in accordance with the procedural rules
of the AMÖ conciliation body in the version valid at the time of the initiation of the conciliation proceedings.
. The conciliation decision shall be binding for the AMÖ forwarder, provided that the subject matter of the complaint is assigned to the
jurisdiction of the district courts according to the Judiciary Act.
18.2 The application for the opening of the conciliation proceedings shall be made in text form.
18.3 The procedure is free of charge for consumers.
